Warrant and Cash Bond Information
How to Obtain a Warrant for Arrest:
A person must get a copy of an Incident/Offense Report from the Andalusia Police Department. The person wishing to obtain the warrant must give a written Affidavit at the Municipal Court Office. A Magistrate at the Municipal Court Office will review the Affidavit and interview the person wanting to obtain the warrant. Probable Cause will be determined by the Magistrate. If Probable Cause is determined, a Warrant of Arrest will be issued by the Magistrate. This Complaint and Arrest Warrant will be filed with the City of Andalusia Police Department. The Warrant will be served by an arresting police officer. Once the Arrest Warrant is served, the defendant may make proper bond which is stated on the Warrant for Arrest by the Magistrate. Based on certain circumstances, special conditions of release may apply in addition to bail
Cash Bond Information:
If the Judge orders it, a cash bond that has been posted for an individual may be held until all orders of the court have been satisfied. Any fines and costs may be ordered by the Judge to be deducted from the cash bond. A person should not post a cash bond, if he/she is not willing for the cash bond monies to be held for a period of time or if he/she does not want fines and costs deducted from the cash bond.
In the event that the court date is continued, said cash bond will be held over for the next court date.
In the event that the cash bond is ordered to be returned in full or in part, it will be in the form of a check from the City of Andalusia. The Municipal Court will only release the check to the defendant, but it could take several weeks for this check to be processed. Proper identification must be presented at the time the check is released. It is also the responsibility of the person posting the cash bond to provide the court office with written documentation in the event of a change of address or telephone number.
